River Terms of Use

1. Publisher

River (provisional name; final trade name: to be determined) is published by ILYGO Sàrl, Switzerland.

2. Purpose and acceptance

These terms govern the use of River, an iPhone app for learning No-Limit Texas Hold'em poker, and of its web pages. By using River, you accept these terms and the privacy policy. If you do not accept them, do not use River.

End User License Agreement (EULA) applicable on the App Store: to be determined (Apple's standard EULA or these terms).

3. Audience: 18 and over

River is restricted to people aged 18 and over. At first launch, you must confirm that you are at least 18; without this confirmation, the app gives access to no content.

River is offered only in the countries chosen by ILYGO (list: to be determined).

4. A learning app, with no real money

• River is an educational app. It is not a gambling game, a casino or a betting service.
• No real stakes: you cannot wager money or anything else of value.
• Fictitious chips: the chips used at the tables have no value. They cannot be bought, sold, exchanged, converted, transferred or withdrawn. The Premium subscription gives access to features; it never provides chips.
• No winnings or prizes: no prize or reward of any value, even symbolic, is awarded, including for the daily puzzle, exams or streaks. Experience points, streaks and the decision index have no monetary value.
• No link with gambling operators: River contains no advertising, no affiliation and no link to any gambling operator.
• No promise of winnings: River teaches you to evaluate your decisions. It does not guarantee any result at poker played for money. Poker involves an element of chance: results with real money vary, and you can lose money. See the Responsible gaming page.
• Prohibited use: you must not use River as an aid during a game played for real money, for example to get advice during a hand in progress.

5. Learning content

• The coach's evaluations, the decision index and the "What if?" mode are calculated by River's engine, against River's simulated opponents. They are learning tools: they do not constitute personalised advice and may not reflect the behaviour of other opponents.
• ILYGO may correct, supplement, change or remove content, including without a new version of the app.
• ILYGO takes care to ensure the accuracy of the content but cannot guarantee that it is free of any error.

6. Account

• An anonymous account is created automatically at first launch with an Internet connection. Learning also works offline.
• You can link your account to your Apple ID ("Save my progress", with Sign in with Apple) to find your progress on another device. If this Apple ID is already linked to another River account, the app offers to merge the two accounts, only after your explicit confirmation.
• Signing out, after confirmation, erases River's data on the iPhone.
• You are responsible for access to your device and to your Apple ID.
• You can delete your account and your data at any time in Settings (see the privacy policy).

7. Free offer and Premium

• Free: levels 0 and 1 and their reviews, the daily puzzle, the Responsible gaming module, and a limited number of hands per day in free play and of "What if?" analyses per day.
• Premium: levels 2 and 3 and further levels when they are published, free play and the "What if?" mode without a daily limit, detailed analysis of decisions, all reviews, the toughest table and, when available, the scenario library and the session review.
• The limits of the free offer and the content of each offer are shown in the app and may change. What is included is presented before any purchase.

8. Subscriptions

• Sold by Apple: Premium is sold as an auto-renewable subscription, monthly or annual, through in-app purchase on the App Store. Payment and billing are handled by Apple; Apple's terms applicable to App Store purchases also apply.
• Price: the price is shown in the app and by the App Store, in your currency, before the purchase. The applicable price is the one shown at the time of purchase or renewal. Reference prices: to be determined.
• Free trial: a 7-day free trial may be offered as an introductory offer, subject to Apple's eligibility rules. At the end of the trial, the subscription automatically becomes paid unless cancelled within the period set by Apple.
• Renewal: the subscription renews automatically at the end of each period, at the price then in force, unless cancelled within the period set by Apple.
• Management and cancellation: from Settings → Subscription → "Manage Subscription", or in your Apple account settings on the iPhone. Cancellation takes effect at the end of the current period; Premium access remains active until then.
• Deleting the app or your River account does not cancel the subscription.
• Refunds: refunds are decided by Apple under its terms; any refund request must be addressed to Apple. A refund or revocation by Apple ends the Premium access linked to the purchase concerned.
• Restore: "Restore Purchases" is available on the offer screen and in Settings → Subscription.
• Billing problem and expiry: during the grace period granted by Apple in the event of a billing failure, Premium access is maintained. When the subscription expires, Premium access ends; your progress is kept and the free offer remains available.
• No other purchases: River sells no chips, no virtual currency and no consumable purchases.

9. Acceptable use

You agree not to:

• circumvent the limits of the free offer or the subscription system;
• access River's servers other than through the app, or disrupt their operation (automated requests, overload, intrusion attempts);
• extract, copy or redistribute River's content;
• use River as an aid during a game played for real money;
• use River if you are under 18.

In the event of a serious breach, ILYGO may suspend access to River's online services for the account concerned.

10. Intellectual property

River, its content (lessons, exercises, puzzles, texts, illustrations), its game engine and its brand belong to ILYGO or its licensors. ILYGO grants you a personal, non-exclusive and non-transferable licence to use River for private, non-commercial purposes, for as long as these terms apply. You may share your daily puzzle result using the iOS share function.

11. Availability

• The learning and game features work without a network. A connection is required to create or link an account, make a purchase, restore purchases, display puzzle statistics and update content.
• ILYGO endeavours to ensure the availability of the online services, without guaranteeing uninterrupted operation. Interruptions for maintenance are possible.
• ILYGO may develop River (features, content) to improve it.

12. Liability

• ILYGO is liable for damage in accordance with applicable law. To the extent permitted by law, ILYGO's liability for slight negligence is excluded. Liability for intent or gross negligence, as well as mandatory consumer rights, are reserved.
• ILYGO is not liable for the decisions you make in games played for real money, nor for any resulting losses.

13. Relationship with Apple

River is distributed through Apple's App Store. Apple is not a party to these terms and is not responsible for River or its support, subject to Apple's terms. Questions about River should be addressed to ILYGO; questions about payment and refunds should be addressed to Apple.

14. Duration and end of use

These terms apply for as long as you use River. You can stop using it at any time and delete your account in the app. An ongoing subscription is cancelled with Apple (section 8).

15. Changes

ILYGO may change these terms. The new version is published on this page with its date. In the event of a significant change, ILYGO will inform you appropriately, for example in the app.

16. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is the registered office of ILYGO Sàrl (to be determined). If you are a consumer, the mandatory provisions and places of jurisdiction provided by the law of your State of habitual residence are reserved.
